Spain parliament recently approved a bill making willingness of an individual, a key determinant in regulatory offence cases.

The legislation commonly referred to as Only Yes is Yes, frees victims from having prove the scenario happened against them.

It defines consent as a precise expression of a person’s will, meaning that silence or passivity can not be equated with consent.

After the approval Equality Minister Irene Montero said, “Spain has become a safer, freer country for ladies.”

“We’re visiting swap violence for freedom. We’re visiting swap fear for desire,” she added.

Under the draft law, non-consensual sex carries a jail term of up to fifteen years.

Other measures include creating a network of 24-hour crisis centres for sex offense victims and their members of the family.

Spain’s left-wing coalition government already supported the order from court where only far-right vox party voted against the bill.
